These Terms of Service (“Terms”) govern access to nodeenginepoint.digital and inquiries or engagements with Nodeenginepoint Trade Marketing (“we”, “us”). By using this website or requesting services, you agree to these Terms.

Services described

We provide trade marketing support for distributor promotion work in Thailand, including activations, POS and merchandising kits, sell-in campaigns, trade promo planning, retailer co-op support, and field force briefing. Descriptions and price ranges on this site are informational only and do not constitute a binding offer.

No online checkout

This website does not process payments or complete purchases. Any fees, deposits, or schedules are agreed separately in writing after scope is confirmed.

Inquiries and proposals

Contact forms and email inquiries are requests for information. We may decline work that falls outside our subject, capacity, or ethical standards. Proposals become binding only when both parties accept a written statement of work.

Client responsibilities

Clients supply accurate channel data, brand assets, product claims, and approvals on time. You are responsible for ensuring promotional mechanics comply with applicable Thai law, retailer rules, and your distributor agreements.

Intellectual property

Website content belongs to us or our licensors. Project deliverables remain our property until agreed fees are paid, after which usage rights transfer as specified in the statement of work. Stock imagery on this site is used under the respective platform licenses and is not transferred to clients.

Acceptable use

You may not misuse the site, attempt unauthorized access, submit malicious content, or scrape the site in a way that impairs service for others.

Disclaimer

The site is provided “as is.” We do not warrant uninterrupted availability or that content will meet every commercial need. Trade outcomes depend on stock, retailer acceptance, field execution, and market conditions outside our sole control.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from site use or marketing outcomes. Our aggregate liability for a paid engagement is limited to fees paid for that engagement in the three months preceding the claim, unless a statement of work states otherwise.

Governing law

These Terms are governed by the laws of Thailand. Disputes are subject to the courts of Bangkok, unless mandatory consumer protections require otherwise.
